What is the agreement between Plymouth Rock and the Massachusetts Attorney General with regard to motorcycles?
 
Plymouth Rock, along with other Massachusetts insurance carriers, was found to have incorrectly calculated motorcycle insurance rates for physical damage coverage on some policies over a period of years. The settlement means that both parties have agreed to a solution that will ensure that Plymouth Rock policyholders who were inadvertently overcharged receive refunds of their overpayments.

What was the error?
 
The error was an incorrect assessment of the motorcycle’s value. The rate calculation used the value of the motorcycle when it was new, failing to take into account depreciation as the vehicle aged.
 
Is my current policy rated correctly?
 
If you bought a new Plymouth Rock motorcycle policy effective on or after 8/8/08, or a renewal policy effective on or after 10/21/09, your policy is rated correctly.
 
What period of time is covered by the agreement?
 
The agreement may affect Plymouth Rock customers who had active motorcycle policies with physical damage coverage and policy effective dates between 1/1/02 and 10/20/09.
 
Why does the agreement only affect policies with those effective dates?

I had a policy effective before 1/1/02. Why aren’t you sending me a refund?
 
The Massachusetts Attorney General’s office provided Plymouth Rock with the dates. Motorcycle physical damage coverage rates are being recalculated for that time period only.
 
 
Can you confirm that I was a customer during that period?
 
Yes, I can:

  • (Option A:) You did have a Plymouth Rock motorcycle policy with physical damage coverage and a policy effective date between 1/1/02 and 10/20/09. If you were inadvertently overcharged, you will be eligible for a refund.
  • (Option B:) Our records do not indicate that you had a Plymouth Rock motorcycle policy with physical damage coverage and a policy effective date between 1/1/02 and 10/20/09.
  • (Option C:) You did have a Plymouth Rock motorcycle policy with a policy effective date between 1/1/02 and 10/20/09, but you did not have physical damage coverage so you were not affected by the rating error.
  • (Option D:) I will have to do some research to determine whether you had a motorcycle policy with physical damage coverage and a policy effective date between 1/1/02 and 10/20/09. Please provide a number where you can be reached and I will contact you with an answer.

 
When will you know whether I am due a refund?
 
We anticipate that refunds will be issued by the end of November, 2010.
 
Why will the process take so long?
 
Plymouth Rock will need some time to recalculate the rates and to coordinate its efforts with the Office of the Attorney General. Everyone who was inadvertently overcharged will be eligible for a refund. If you are one of the affected policyholders, you will receive interest on any overpaid premiums.
 
When will I receive my check?
 
We anticipate that refunds will be issued by the end of November, 2010.
 
What do I need to do to get my refund?
 
Nothing. Plymouth Rock will take care of all of the details and refunds will be sent to eligible policyholders automatically.
 
I changed my address over the past few years. Where are you sending the refund? I want to give you my new address today.
 
If you are still a Plymouth Rock policyholder, any refund due to you will be sent to the mailing address Plymouth Rock has on file. If you are no longer a Plymouth Rock customer, I’ll be happy to take your updated address information.
 
What do I do if I don’t receive a check by early December?
 
If you believe you are entitled to a refund and have not received a check by December 15, 2010, please contact us again. We’d be happy to help.
 
I don’t remember who my agent was at that time. Can you still help me?
 
Yes. You may have to provide some additional information but we’ll be happy to assist you.
